Most litigated diseases in medical malpractice: It is difficult to ascertain which diseases cause the most lawsuits in relation to medical malpractice, or indeed to other areas of law such as personal injury. However, it is clear that some of the diseases that cause the greater amounts of dollar payouts include heart attack, appendicitis, lung cancer, colorectal cancer, and breast cancer, not necessarily in that order. Clearly these are the diseases for which it is hard to diagnose, are often misdiagnosed, and such misdiagnosis often leads to severe disease and death. Thus, these diseases may not cause the most lawsuits, but the payouts are high because the injury to the plaintiff typically involves death or severe disability.
